1. Agreement to Terms
By creating an account, placing an order, or using the TagBuilder.net website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
When creating an account, you will be required to acknowledge and agree to these Terms before your registration can be completed.
2. The Service
TagBuilder.net provides users with tools to design, customize, and order engraved tags, labels, and other products ("Products"). The Service generates a visual preview based on user-provided data. This preview is a digital representation and is the basis for the final manufactured Product.
3. User Responsibility for Accuracy
You, the user, are solely and exclusively responsible for the accuracy of all information, text, values, and specifications entered into the Tag Builder tool. This includes, but is not limited to, spelling, grammar, numerical data, dimensions, and material selections.
The preview generated by the Service is the final proof. By submitting an order, you are approving the preview and confirming that all data entered is correct. **Solid Ideas (the "Company") will manufacture the Products exactly as they appear in the user-approved preview.**
4. Limitation of Liability
Solid Ideas is a manufacturing service that acts on the specific instructions provided by the user. The Company shall not be held liable for any errors, misprints, or inaccuracies on the final Product that were present in the user-submitted and approved design. There will be no refunds, returns, or reprints for user-generated errors.
Furthermore, the Products are provided "as is" for installation and use by the customer. Solid Ideas, shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the installation, use, or misuse of the Products. The suitability of any Product for a specific application is the sole responsibility of the user.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Solid Ideas. You may not use the Company's branding, logos, or website content without prior written consent.
6. Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.
8. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Erie County, Pennsylvania before one arbitrator. The arbitration shall be administered by an arbitration service of the Company's choosing, pursuant to its Comprehensive Arbitration Rules and Procedures.
You agree that by entering into these Terms, you and the Company are each waiving the right to a trial by jury or to participate in a class action. If any dispute proceeds in court rather than in arbitration, you and the Company waive any right to a jury trial.
In the event of any legal dispute or arbitration, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs from the other party.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
