Terms of Service — TagBuilder / Solid Ideas Engraving

1. Introduction — Who We Are
Solid Ideas Engraving (“Solid Ideas,” “Company,” “we,” “us,” or “our”) operates the TagBuilder.net website and related services (the “Service”). By creating an account, logging in, placing an order, or otherwise using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms and any posted policies (including our Privacy Policy). We may update these Terms at any time; the effective date will be revised accordingly. We may, but are not obligated to, notify you by email or account notice. Your continued use after updated Terms are posted constitutes acceptance.
3. Eligibility & Proper Use
You must be at least 18 years old and able to form a binding contract. The Service is intended for business within the 50 United States. We ship only to U.S. addresses. Orders with non-U.S. shipping addresses will be canceled with a full refund to the original payment method, less any non-refundable processor or currency-conversion fees. Use of VPNs or other tools to obscure location for competitive, fraudulent, or prohibited purposes is strictly prohibited, and we may block access from non-U.S. IP ranges or suspicious traffic.
You agree to use the Service only for lawful purposes. Prohibited conduct includes:
Payment fraud, use of stolen methods, identity theft, or false information.
Competitive misuse, including accessing the Service to benchmark or copy.
Reverse engineering, copying, modifying, or attempting to extract source code, algorithms, or workflows.
Automated scraping, crawling, bulk downloading, or any data harvesting.
Spamming, denial-of-service activity, or interference with functionality.
Unauthorized access to restricted areas or systems.
We may verify identity, payment, or location and may suspend, cancel, or report activity to payment processors or law enforcement. Repeated unfounded disputes may result in permanent bans or collection action.
4. Original Development & Ownership
The Service, its source code, designs, and workflows were independently developed by Solid Ideas Engraving, leveraging 27 years of industry experience. All intellectual property rights remain exclusively with Solid Ideas. No ownership, license, or implied rights are granted except as explicitly stated. Any attempt to clone, reproduce, or derive work from the Service will be prosecuted to the fullest extent of the law.
Trademark Use: You may not use our name, logos, trademarks, or trade dress without our prior written consent.
5. Monitoring, Security & Enforcement — Consent to Tracking
You consent to our use of security analytics including IP tracking (city-level), telemetry, access logs, rate-limiting, and anti-fraud systems to detect and prevent misuse. These logs may also serve to document independent development. We may share relevant data with payment processors or law enforcement and pursue all civil or criminal remedies, including injunctions, damages, and attorneys’ fees.
6. Account Registration & Security
You must provide accurate, current information and safeguard your credentials. You are responsible for all account activity. Notify us immediately at mickie@solidideas.net if you suspect compromise. Deleting an account does not entitle you to refunds for prior orders. Accounts and orders are non-transferable without written consent.
7. User Content & License to Manufacture
You are solely responsible for all text, images, and designs you upload (“User Content”). You warrant that you own or have rights to use it and that it does not violate law or third-party rights. We may reject User Content suspected of infringement or illegality. You grant Solid Ideas a non-exclusive, worldwide, royalty-free license to use and process User Content solely to produce your order and support the Service. You retain ownership but waive moral rights of attribution.
8. Order Approval & Responsibility
The digital preview is your final proof. By submitting an order, you confirm accuracy of design and specifications. Orders are custom-made and non-refundable once production begins.
Defects: A defect is a material manufacturing error by us (e.g., wrong material selected by us, engraving errors not in the approved preview, dimensions off by more than 5%), excluding customer errors (e.g., typos in your submission, material color variations). Report within 10 days of delivery to mickie@solidideas.net with photos and details. We may replace or refund defective items at our discretion.
9. Pricing, Payment & Taxes
Prices and shipping costs are shown at checkout. Payment must be completed via PayPal before order entry. We do not store payment data and may verify details for fraud prevention. Refunds are issued only to the original payment method. You agree to contact us to resolve issues before initiating a chargeback.
10. Order Cancellation & Refund Policy
We may cancel any order prior to shipment for any reason (e.g., suspected fraud or policy violation). If payment has been processed, a full refund to the original method will be issued. No refunds apply once production has begun or after shipment.
11. Shipping & Risk of Loss
Processing and shipping times are estimates only. We are not liable for carrier delays or damage beyond our control. Title and risk transfer upon delivery to the carrier. File damage/loss claims with the carrier; we will assist reasonably.
12. No Warranties
THE SERVICE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS, TITLE, AND NON-INFRINGEMENT ARE DISCLAIMED. Engraved products are for identification only and not electrical or safety certifications.
13. Limitation of Liability
To the maximum extent allowed by law, our liability will not exceed the greater of (a) the amount you paid for the affected order or (b) $100 USD. We are not liable for indirect or consequential losses except for gross negligence or willful misconduct.
14. Indemnification
You agree to defend and indemnify Solid Ideas and its personnel from claims arising from your use, violations, or User Content. We may choose our own counsel in such defense.
15. Communications & Marketing
You consent to receive transactional emails and texts for orders and support. You may opt out of promotional messages via unsubscribe links or by emailing mickie@solidideas.net. Opting out of transactional messages may limit service delivery.
16. Force Majeure
We are not liable for delays caused by events beyond our control, including natural disasters, labor shortages, power failures, or pandemics.
17. Dispute Resolution & Arbitration
All disputes arising from these Terms will be resolved by binding arbitration in Erie County, Pennsylvania, before a single arbitrator. Either party may bring eligible claims in small claims court in Erie County. Opt-Out: You may opt out of arbitration by sending written notice to legal@tagbuilder.com within 30 days of your first purchase. Both parties waive jury trial and class actions. Solid Ideas may file court actions to protect its intellectual property or seek injunctive relief.
18. DMCA Policy
To report copyright infringement, email legal@tagbuilder.com with the information required under 17 U.S.C. §512(c)(3) (e.g., your signature, identification of the infringed work, location of infringing material, your contact info, good-faith belief of infringement, statement under penalty of perjury). Due to the current federal government shutdown, our designated DMCA agent registration is pending with the U.S. Copyright Office; contact details will be available at copyright.gov upon registration completion. Knowingly false DMCA claims may result in damages and fee recovery under 17 U.S.C. §512(f).
19. Governing Law
These Terms are governed by Pennsylvania law, excluding conflict-of-law rules.
20. Remedies & Attorneys’ Fees
Unauthorized copying, scraping, or fraud may cause irreparable harm. We may seek injunctions and recover attorneys’ fees and costs. Prevailing parties in any related action are entitled to fee recovery.
21. Survival
Sections 3–5, 7–9, 12–14, 17–20 and any that by nature should survive termination remain effective after account closure.
22. Severability & Waiver
If any provision is unenforceable, the remainder stays valid. Failure to enforce a right is not a waiver.

These Terms, together with our Privacy Policy and posted policies, form the entire agreement between you and Solid Ideas.
